Parliament adopts public procurement law

The Transitional National Legislative Assembly (TNLA) on Monday adopted and passed the Public Procurement and Disposal of Assets Regulation 2024 after deliberations.

The regulation, which was tabled in July by former Finance Minister Awow Daniel Chuang, is to operationalize the Public Procurement and Disposal Assets Act 2018.

It includes providing average bidding documents, requests for proposals, and other forms to be used on a mandatory basis for procuring entities.

Furthermore, the regulation is to improve incomes for suppliers or contractors and create employment as well as government revenues through taxes from suppliers and service providers.

The TNLA Committee of Finance and Economic Planning Chairperson, Changkuoth Bichiok, said the joint committees of Finance and Economic Planning, Public Accounts, Legislation and Justice, conducted three-day workshop through World Bank Group, and later incorporated the ideas generated.

“The necessary inputs generated from the workshop, and the committee’s meeting, were incorporated to enrich this regulation. This regulation was tabled in the august House as required by Section 83, (1) of the Public Procurement and Disposal of Assets 2018, read together with regulation 37 (1), TNLA Conduct of Business Regulation as amended 2021, and therefore, this regulation should be passed in one sitting,” he emphasized.

Bichiok said the regulation was paramount because it is one of the laws required by the peace agreement.

“The Public Procurement and Disposal of Assets system is one the priorities of the Government of South Sudan as stipulated in the 2018 Revitalized Agreement.
