High court in Jonglei cancels mayor’s decision to dismiss bench court members

On 29 May, the mayor of Bor town issued a decision appointing nine new members to Bor town bench court after dismissing nine chiefs over misconduct. The court was set up to solve social and domestic disputes in the town.

The high court judge accused the mayor of violating Article 122 in the Transitional Constitution of South Sudan 2011.

“The mayor’s administrative order is deemed null and void and neither case shall be referred to it, nor warrant or order shall be regarded as lawful,” partly reads Ajang’s letter.

“Election or selection of the chiefs for the bench court and their terms and conditions of service are enshrined under section 105 and 106 respectively of the Local Government Act 2009,” it added.
